These are the terms that apply when you book or join a Niagara Falls Tours America tour, transfer or group experience. Plain English, no surprises — please read before you book.
1. Your agreement
By booking a tour, paying a deposit, or boarding one of our vehicles, you agree to these Terms on behalf of yourself and every guest in your party. Bookings can only be made by adults aged 18 or older. If you don't agree with anything below, please don't book — call +1 647 477 1520 and we'll talk it through first.
2. Bookings & payment
- Daily group tours: full payment is taken at the time of booking.
- Private tours: a deposit or full payment may be required, depending on date and party size — confirmed in your quote.
- Group bookings (15+): a written contract with deposit terms is sent separately by the group coordinator.
- Card payments are processed by Stripe. Card data is never stored on our servers.
- You'll receive a confirmation email with your booking reference. Please check it for accuracy and reply within 24 hours if anything is wrong.
3. Prices & taxes
All prices on this website are in U.S. dollars and shown per person unless stated. Where required, applicable taxes and gratuities to your guide are not included in the displayed rate and will be itemized at checkout or in your written quote. Prices may change without notice; the price confirmed in your booking email is what you pay for that booking.
4. Cancellations & refunds
Quick summary: cancel 96 hours or more before your tour start time for a full refund. Less than 96 hours: no refund. Full detail — including private, airport and group rules — is on our Cancellation Policy page.
Refunds are returned to the original payment method within 5–10 business days of approval. Refund requests must be made by email to [email protected] with your booking reference.
5. Tour changes & weather
Niagara is a real place with real weather. We reserve the right to:
- Adjust the order, length or content of any tour to keep guests safe and on schedule.
- Substitute an attraction of equivalent value if one is closed (e.g. Maid of the Mist out of season is replaced with Cave of the Winds, and vice versa).
- Cancel a departure for severe weather, road closures, or low bookings — in which case you'll be offered a full refund or an alternate date at your choice.
- Replace a vehicle, guide or pickup time if operationally necessary; you'll be notified by phone or email as soon as we know.
We aren't responsible for delays caused by traffic, customs queues, attraction operator changes, or other circumstances outside our reasonable control.
6. Border crossing & ID
Tours that cross into Canada are subject to U.S. and Canadian border requirements. You are responsible for:
- Bringing a valid passport (or other accepted document — see the tour's detail page).
- Having any required visa or eTA in place before your tour date.
- Answering border officers' questions truthfully and respectfully.
- Any fees, fines or onward travel costs if you are refused entry at either border.
If a guest is turned back at the border, the rest of the group continues; no refund is given for the refused guest's portion of the tour.
7. Conduct & safety
Our guides have the right to remove any guest who is intoxicated, behaving unsafely, harassing other guests or staff, or refusing reasonable safety instructions. Removal in this scenario is treated as a no-show and is not refundable. Guests assume normal travel risks associated with walking, climbing stairs, wet surfaces and outdoor sightseeing. If you have a mobility need, please tell us before booking so we can advise on suitability.
8. Liability
To the maximum extent permitted by law, Niagara Falls Tours America's total liability arising out of or in connection with any booking is limited to the amount you paid for that booking. We are not liable for:
- Indirect, consequential or special loss (including loss of enjoyment, missed flights or onward travel).
- Acts or omissions of attraction operators, hotels, airlines or other third parties.
- Events outside our reasonable control: severe weather, strikes, pandemic-related closures, government action, civil unrest, fire, flood or similar.
Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, or any other liability which cannot be lawfully excluded.
9. Photos & media
Our guides often take group photos and share them with guests after the tour. By joining a tour you agree that incidental images of you may appear in our marketing (website, social, brochures) unless you tell your guide at the start of the tour that you'd prefer not to be photographed. You can also email [email protected] at any time to have an image removed.
10. Site & content
All text, images, video and design on this site are © Niagara Falls Tours America unless otherwise noted. You may share links and quote short excerpts with credit. Republishing, scraping, or training AI models on the content without written permission is not allowed.
11. Governing law
These Terms are governed by the laws of the State of New York, USA. Any dispute that can't be resolved by friendly discussion will be brought in the state or federal courts located in Niagara County, New York, and both parties consent to that jurisdiction.
